Canadian Tamil Congress Message on the 13th Year May Mullivaikkal Remembrance – Remembering the Silent Voices

May 18 is Tamil Genocide Remembrance Day for Tamils in Canada and around the world. Today, we mourn the thousands of innocent Tamil lives that were lost and we remember the families who were torn apart and have been left with no answers.

According to reports from the United Nations, during the last stages of the war, 40,000-70,000 people were killed or disappeared in what can be described as a war without witnesses. Journalists, along with UN observers, were banned as thousands of people were massacred.

Thirteen years later, the wounds linger, of justice forgotten, of human rights buried alongside the innocent.

Many Tamil Canadians still have or know loved ones who have gone missing, never to be heard from again. As each year passes, we are nowhere close to seeing justice and accountability for the flagrant human rights violations, war crimes and crimes against humanity that unraveled during the final phase of the war.

As we remember, we continue our call for the investigation of and accountability for the serious violations and abuses of human rights and war crimes in Sri Lanka. There is too much at stake when the democratic world ceases to push for human rights, accountability and justice. The deafening silence of the democratic countries while these atrocities were committed against thousands of innocent lives 13 years ago remains today, allowing the perpetrators of war crimes and crimes against humanity continue to evade justice.

While UN bodies have acknowledged the loss of thousands of lives and indiscriminate shelling in safe zones, minimal progress has been made in seeking justice and accountability.

• Not a single case involving wartime atrocities has been resolved in a court of law.

• Not a single Tamil victim of enforced disappearance has been found alive or the circumstances of their disappearance revealed to date.

• Not even a single person was held accountable.

We urge UN Member States, including Canada to prevent perpetrators of these international crimes in Sri Lanka from evading justice, to adopt a parallel process on accountability, such as an international criminal tribunal, to supplement efforts by the UN Human Rights Council to deal with mass atrocity crimes committed in Sri Lanka during and after the war.

For more than two years, Canadian Tamil Congress (CTC) has been advocating for the imposition of Magnitsky Act sanctions on perpetrators of gross violations of internationally recognized human rights (as set out in the Act) who are currently members of the present Sri Lankan government and military. The UN Human Rights Council’s High Commissioner’s recommendations on Sri Lanka also call for above sanctions from its member states and CTC continues to urge the Canadian government to act without any further delay.

On this day, we remember the lives lost in the massacre of Mullivaikkal and continue to call for justice and accountability for the crimes committed during and after the war.

கனடியத் தமிழர் பேரவையின் “பதின்மூன்றாவது ஆண்டு மே முள்ளிவாய்க்கால் நினைவேந்தல்” அறிக்கை !

மே 18, கனடாவிலும் உலகெங்கிலும் வாழும் தமிழர்கள் தமிழின அழிப்பை தாங்கொணாத வேதனையோடு நினைவு கொள்ளும் நாள். இந்நாளில் முள்ளிவாய்க்கால் பேரவலத்தில் உயிரிழந்த பொதுமக்களுக்காக அஞ்சலி செலுத்தியும், சொந்தங்களை இழந்து பதில் ஏதுமில்லாமல் வாடும் குடும்பங்களை நினைவில் இருத்தியும் ஆன்ம விரதம் பூணுகிறோம்.

ஐ.நா அறிக்கைகளின்படி, போரின் கடைசிக் கட்டத்தில் 40,000-70,000 பேர் வரையிலான பொதுமக்கள் கொல்லப்பட்டுள்ளார்கள். சாட்சிகள் இல்லாத இந்தப் போரில் கொல்லப்பட்டவர்கள் குறித்த கணக்கு இதுவரையில் காட்டப்படவில்லை. ஆயிரக்கணக்கான பொதுமக்கள் அழிக்கப்பட்ட வேளையில், ஐக்கிய நாடுகள் சபையின் பார்வையாளர்களும் ஊடகவியலாளர்களும் யுத்த பிரதேசங்களுக்குள் நுழைய முடியாதபடி தடை செய்யப்பட்டிருந்தனர்.

பதின்மூன்று ஆண்டுகளுக்குப் பிறகும், போரின் விளைவான அந்தக் காயங்கள் ஆறவில்லை. நீதி மறக்கப்பட்டாயிற்று. கொல்லப்பட்ட அப்பாவிப் பொதுமக்களோடு மனித உரிமைகளும் தோண்டிப் புதைக்கப்பட்டுள்ளது.

பல தமிழ் கனடியர்கள், அந்தப் போரின் போது காணாமல் போன அன்பானவர்களைக் கொண்டிருக்கிறார்கள்…அறிந்திருக்கிறார்கள். போர் நடைபெற்றுப் பல ஆண்டுகள் கடந்தும் அங்கு நிகழ்ந்த மனித உரிமை மீறல்களுக்கோ, மனித குலத்திற்கு எதிராக நடத்தப்பட்ட மாபெரும் போர்க் குற்றங்களுக்கோ இதுவரை பதில் ஏதும் இல்லை. பெற்றோர்கள் இல்லாமல் வளரும் குழந்தைகளுக்கும், அன்புக்குரியவர்கள் இல்லாத துணைகளுக்கும் ஆறுதல் இல்லை.

இலங்கையில் நடைபெற்ற மோசமான மனித உரிமை மீறல்கள், துஷ்பிரயோகங்கள், போர்க்குற்றங்கள் குறித்து விசாரணை மற்றும் பொறுப்புக்கூறல் ஆகியவற்றையே நாங்கள் கோருகிறோம். மனித உரிமை, பொறுப்புக்கூறல், நீதியுடனான சமாதானம் போன்றவற்றுக்காக அழுத்தம் கொடுப்பதை ஜனநாயக உலகம் நிறுத்தும்போது, அமைதி காக்கும்போது மனித குலத்துக்கு எதிரான மிகப்பெரும் ஆபத்து உருவாகிறது.

பல்லாயிரக்கணக்கான உயிர்களின் இழப்பு மற்றும் பாதுகாப்பு வலயங்கள் மீதான கண்மூடித்தனமான எறிகணைத் தாக்குதல்களை ஐ.நா. அமைப்புகள் ஒப்புக்கொண்டாலும், மிகச்சிறியளவிலான முன்னேற்றம்தான் நிகழ்ந்துள்ளது.

போர்க்கால அட்டூழியங்கள் தொடர்பான ஒரு வழக்குக் கூட நீதிமன்றத்தில் தீர்க்கப்படவில்லை.
பலவந்தமாக காணாமல் ஆக்கப்பட்டவர்களில் ஒரு தமிழர் கூட இன்று உயிருடன் காணப்படவில்லை. அவர்கள் காணாமல் போனதற்கான சந்தர்ப்ப சூழ்நிலைகள் கூட இதுவரை வெளிப்படுத்தப்படவில்லை. இலங்கை அரசாங்கத்தை சார்ந்த எந்த ஒரு நபர் கூட இவற்றுக்கான பொறுப்பை ஏற்கவில்லை.

இலங்கையில், பதின்மூன்று ஆண்டுகளுக்கு முன்னர் முடிவடைந்த போரின் போதும், அதற்குப் பின்னரும், இவ்வகையிலான சர்வதேசக் குற்றங்களைச் செய்தவர்கள் தப்பிவிடாமல் இருப்பதற்கான ஏற்பாடுகளை செய்யுமாறு கனடா உள்ளிட்ட ஐ.நா உறுப்பு நாடுகளை நாங்கள் கேட்டுக்கொள்கிறோம். அதே வேளையில் பாரிய அட்டூழியக் குற்றங்களைக் கையாள்வதற்கான UNHRC இன் முயற்சிகளுக்குத் துணைபுரிய “சர்வதேச குற்றவியல் Tribunal” மூலம் பொறுப்புக்கூறல் தொடர்பான செயல்முறையை இந்த நாடுகள் நடைமுறைப்படுத்த வேண்டும்.

சர்வதேச ரீதியில் அங்கீகரிக்கப்பட்ட மனித உரிமைகள் சட்டத்திற்கு அமைவாக, தற்போதுள்ள இலங்கை அரசாங்கம், இலங்கை இராணுவம் ஆகியவற்றில் அங்கம் வகித்த, வகிக்கும் “சட்டங்களை மீறிய குற்றவாளிகள்” மீது “மாக்னிட்ஸ்கி சட்டத் தடைகளை” நடைமுறைப்படுத்துமாறு இரண்டு ஆண்டுகளுக்கு மேலாக கனடியத் தமிழர் பேரவை போராடி வருகிறது.

“ஐக்கிய நாடுகள் சபை மனித உரிமைகள் மன்று” உயர் ஆணையாளர், அதன் அங்கத்துவ நாடுகளுக்கு, இலங்கை அரசில் அங்கம் வகித்த, வகிக்கும் போர்க் குற்றவாளிகளுக்கு மேற்படி தடைகளை ஏற்படுத்துமாறு பரிந்துரைத்திருந்தார். அவ்வாறான நடவடிக்கைகளை எவ்வித காலதாமதமும் இல்லாமல் இலங்கை அரச போர்க் குற்றவாளிகள் மீது கனடிய அரசு மேற்கொள்ள வேண்டுமெனக் கனடியத் தமிழர் பேரவை தொடர்ந்து குரல் கொடுத்து வருகிறது.
